General Terms and Conditions

These General Terms and Conditions govern the contractual relationship between TODO TRAVEL (hereinafter referred to as the tour operator) and the customer for all trips and services booked via our website, by email, or through our partners.

1. Conclusion of Contract

By booking a trip or service, the customer submits a binding offer to conclude a contract.

The contract becomes effective once TODO TRAVEL confirms the booking in writing (e.g., via email).

By making a booking, the customer accepts these General Terms and Conditions as part of the contract.

2. Services Provided by the Tour Operator

The scope of the contractual services is determined by the travel description on our website and the booking confirmation.

Changes to individual services may occur, provided that the overall character of the trip is not significantly altered.

3. Mediation of Third-Party Services

If TODO TRAVEL arranges services provided by third parties (such as hotels, rental cars, transfers, or excursions), the terms and conditions of those providers apply.

In such cases, TODO TRAVEL acts solely as an intermediary and is not the contractual partner for these services.

4. Prices and Payment Conditions

Unless otherwise stated, all prices are per person in euros.

Payment terms are specified in the booking confirmation.

Unless otherwise agreed:

  • a deposit is due upon booking

  • the remaining balance must be paid before the start of the trip

For last-minute bookings, the full travel price may be due immediately.

If payment deadlines are not met, TODO TRAVEL reserves the right to withdraw from the contract and charge cancellation fees.

5. Cancellation by the Customer

Cancellations must be made in writing (e.g., by email).

The following cancellation conditions apply:

  • up to 31 days before departure: 20%

  • up to 21 days before departure: 40%

  • up to 10 days before departure: 65%

  • less than 9 days before departure: 100%

  • no-show: 100%

The relevant date is the date the written cancellation is received.

6. Replacement Participant

The customer may nominate a replacement participant before the start of the trip, provided that the person meets all travel requirements and the service providers agree.

Any additional costs incurred must be borne by the customer.

7. Changes or Cancellation by the Tour Operator

TODO TRAVEL may cancel or modify trips for important reasons, particularly in the following cases:

  • failure to reach the minimum number of participants

  • force majeure

  • natural disasters

  • political unrest

  • government restrictions or measures

In such cases, a comparable alternative trip will be offered or payments already made will be fully refunded.

Further claims are excluded.

8. Early Termination of the Trip by the Customer

If the customer terminates the trip early, there is generally no entitlement to a refund.

Unused services may be refunded only if no costs are incurred by TODO TRAVEL.

Any additional costs for early return travel must be borne by the customer.

The purchase of travel cancellation and travel interruption insurance is strongly recommended.

9. Complaints During the Trip

Any complaints must be reported immediately to the tour guide or the relevant service provider so that a remedy can be provided.

Claims against TODO TRAVEL must be submitted in writing within 30 days after the end of the trip.

10. Liability

TODO TRAVEL is responsible for the careful organization of the agreed travel services.

No liability is assumed for:

  • flight delays or schedule changes

  • loss or theft of personal belongings

  • events of force majeure (e.g., natural disasters, political unrest, strikes)

Liability is limited — to the extent permitted by law — to the total price of the booked travel services.

11. Entry Requirements

Customers are responsible for ensuring that they have:

  • valid travel documents

  • required visas

  • necessary vaccinations or health requirements

Information provided on our website generally applies to citizens of EU and EFTA countries.

​

12. Applicable Law and Jurisdiction

Moroccan law applies.

The place of jurisdiction is the Commercial Court of Agadir (Morocco).

Participation Requirements & Health

Participation in trips and activities organized by TODO TRAVEL requires a normal level of physical and mental fitness.

Many of our programs take place in remote regions of Morocco, particularly in the Atlas Mountains, desert areas, or rural regions where infrastructure and medical services may be limited.

Customers are responsible for ensuring that their health condition allows them to participate in the booked trip.

Participants must inform TODO TRAVEL before the start of the trip about any relevant health conditions, such as:

  • cardiovascular diseases

  • severe allergies

  • mobility limitations

Participants must follow the instructions of tour leaders, local guides, and safety personnel at all times.

Failure to comply with these instructions may result in exclusion from certain activities or from the remainder of the trip without entitlement to a refund.

​

The purchase of travel insurance including medical coverage and repatriation is strongly recommended.

Liability Disclaimer for Activities

​

Many programs offered by TODO TRAVEL include outdoor activities such as:

  • trekking in the Atlas Mountains

  • desert tours and camel trekking

  • hiking tours

  • cultural expeditions in remote regions

  • activities in natural environments

  • ​

These activities involve a certain level of inherent natural risk.

Despite careful planning, experienced guides, and high safety standards, risks cannot be completely eliminated.

Participation in such activities is therefore at the participant’s own risk.

TODO TRAVEL is not liable for damages resulting from:

  • participants’ own actions

  • failure to follow safety instructions

  • unpredictable natural events

  • animal behavior

  • climatic or geographical conditions

  • ​

Participants are responsible for bringing appropriate equipment and following all instructions provided by the guides.
